Part of the problem is ATF refuses to do determination letters for parts or accessories. They will only evaluate complete firearms for NFA compliance. That's why the binary triggers I sell don't have a ATF letter.
In the Q case, the ATF states that the Honey Badger was determined to be an SBR "holistically" & flat out refused to give any guidelines for manufacturers to work with.

No problem I’m in Stockbridge
I have all the necessary tools, Its just a matter of digging it back out of the safe and figuring out which one of these KK lunatics was right on which part to start filing.

I figured I'd start with advice from the least likely to commit homicide in a Darth Vader costume while eating cotton candy and then work my way up from there.

I would think it would be EXTREMELY hard to work up a way to take back any registered, tax paid, NFA item.
It should be. But it is unfortunately not. All they have to do is change the rule so that you have to do something like pay $1,000 tax every year to maintain the stamp. Not saying they will or that it would work well. But it's done in lots of industries all the time. Hopefully this causes enough of an uproar to stop the bullshit.

What I'm hoping to see is that, since the ATF issued rulings in the past that braces are legal, they have to confine this issue to Q AND issue clear guidelines on what differentiates a pistol from an SBR.

If you want SBRs you’re honestly in the golden modern age of getting them. Efile is up and running and on average it’s a 3 week turn around. Wait until efile shuts down again and we’re paper filing and back to 13 month wait times.

If you’ve been on the fence about SBRing a lower or any other weapon you want to SBR now is the time to do it

Having to issue that clear guideline on the differences might in fact be enough to sink braces on a whole, the gray area has actually kind of been the protecting force over shouldering them, LOP, adjustability etc. still agree with what we were saying in regards to zero-possibility of grand fathering any brace if they lean that way.

the SBR thing would be enough to turn the whole world upside down, a negative opinion/ruling on pistol braces might even be enough

1 hour
- how about 15 seconds?
1/2 hour?
-how about 10 seconds?
You’re going the wrong way?
-am I? 5 seconds final offer
Ok I’ll take it
Done, 5 seconds it is.
