True, but few people have the resources to fight a government with unlimited resources.
If you truly fall within the guidelines that don't require an ffl, it shouldn't take much cash to prove it. The likelihood of you being falsely charged is also pretty slim, as resources are tight, agents are few, and they aren't going to chase cases they know they won't win. It's pretty obvious that they want to go after some "big fish" that are probably already on their radar.
Just obey the law, and you'll be just fine.

I am going to blow a gasket unless someone can tell me whether or not I have to be fingerprinted and such if I don't buy anymore nfa items on my trust and just keep the ones I have?
You have to be fingerprinted to buy ammo now.

True. Maybe I'm tin foil hat right now but methinks the architecture is in place to eliminate sites like this between the executive branch ' s new found power to regulate the constitution and the fcc's ever expanding power from net neutrality. It might not be soon,but I think it's coming.

Considering that a trusted friend had the ATF show up on his doorstep last year for selling a few lowers, I'm a little less optimistic.

There is some gray, but it seems pretty straightforward.
If you are liquidating a collection..ok
If you sell last years model rifle to fund the purchase of this years model..ok
If you occasionally sell some guns out of your collection..ok

If you advertise as a buyer and seller of firearms and purchase with intention of selling..not ok
If you purchase regularly with the intent of profiting from your sales...not ok.

Yeah it's murky, but it's not that different than it was before. Just don't load up gunbroker with 20 AR's after a shooting looking to cash in on the hype.

Use your head. Stay legal and stay off of the radar. I have a feeling that people will know when they are breaking the law.

Hell, this is an anti-flipper law...the ODT should be loving it. lol

Yes he was and no he didn't. But it is not a position I ever want to be in. Let's just say that it was not pleasant.
I can' imagine it was very unpleasant, that's why I wouldn't go anywhere near that line. Also, there were zero legal repercussions for him. The law worked, and the truth came out.

The resounding theme I keep seeing in the ATF wording is "selling for a profit"... Just don't sell for a profit- you can lose $5 on every gun you buy or trade and definitely say with a straight face "I'm not in this hobby for a profit or livelihood" should they decide to come knock on my door.

Honestly, I can't think of a single gun I've bought and later actually sold for more money. Generally speaking, I sell the thing for about what I paid for it, but it comes with more mags/night sights/etc... This is why I don't own my own business.

I've already been through that, and yeah it sucks and it's expensive. The law enforcement officers were in the wrong by charging me, but the law revealed my innocence, and I'm grateful for that. There'll always be ignorance in enforcement, I just hope that laws are clearly enough defined to prevent innocent people from being found guilty. That's why this law scares me. It's a lot more ambiguous than it should be considering the consequences for breaking it.
